Volgens advocaat-generaal Szpunar is het elektronische platform Uber weliswaar een innovatief concept, maar behoort het desondanks tot de vervoerssector, zodat Uber kan worden verplicht om te beschikken over de volgens het nationale recht vereiste vergunningen en licenties
